These Terms of Use ("Terms") govern your access to and use of our GPS tracking devices, software, mobile applications, websites, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use our Services. By using the Services, you represent and warrant that you meet these requirements.

2. Account Registration

To use certain features, you may be required to register an account. You agree to:

  • Provide accurate and complete information.
  • Keep your account credentials secure.
  • Be responsible for all activities that occur under your account.

We reserve the right to suspend or terminate your account if we suspect misuse or unauthorized activity.

3. Services Provided

Our Services enable users to track real-time GPS locations of vehicles using our hardware and software. Features include (but are not limited to):

  • Live location tracking
  • Historical route playback
  • Geo-fencing alerts
  • Device status monitoring
  • Account and alert management

We may update or modify features without prior notice to improve user experience or ensure compliance with regulations.

4. User Responsibilities

You agree to:

  • Use the Services only for lawful purposes.
  • Comply with all local, national, and international laws and regulations, including privacy and data protection laws (e.g. GDPR).
  • Obtain all necessary consents if you track devices in vehicles used by other individuals.
  • Not use the Services to stalk, harass, or illegally monitor any person.

You are solely responsible for any data you input or collect via the Services.

5. Data Privacy and Security

We are committed to protecting your data. Please review our Privacy Policy for information on how we collect, use, and protect personal data. Key points include:

  • Only essential personal data (e.g., phone number, GPS location) is collected.
  • End-to-end encryption is used for sensitive location data.
  • Data is never sold or shared with third parties for advertising.
  • GDPR rights (access, correction, deletion, etc.) are fully respected.

6. Ownership and Intellectual Property

All content and technology used in our Services (including software, interface, logos, and documentation) are owned or licensed by GPS Tracking Solutions Ltd. and are protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our software or content.
  • Reverse engineer or attempt to extract source code.
  • Use our trademarks without permission.

7. License to Use

We grant you a limited, non-exclusive, non-transferable license to use our Services for lawful vehicle tracking purposes. This license is subject to your compliance with these Terms.

8. Payment and Fees (If Applicable)

If you purchase a subscription or device:

  • You agree to pay all applicable fees.
  • Fees are non-refundable unless required by law.
  • We may suspend access for non-payment.
  • You are responsible for any applicable taxes.

We may change pricing or billing terms with advance notice.

9. Service Availability and Limitations

While we strive for 24/7 availability, the Services may be interrupted for maintenance, upgrades, or network issues. We are not liable for downtime caused by third-party failures (e.g. mobile carriers, GPS satellites). We reserve the right to modify or discontinue features at any time.

10. Prohibited Use

You may not use the Services to:

  • Track individuals without their consent where required by law.
  • Interfere with or disrupt the Services or networks connected to it.
  • Transmit malware or harmful code.
  • Misrepresent your affiliation with GPS Tracking Solutions.

We reserve the right to investigate and report violations to law enforcement.

11. Termination

We may suspend or terminate your access to the Services if you violate these Terms or if required by law. You may stop using the Services at any time. Upon termination:

  • Your license to use the Services ends.
  • We may retain your data as required by legal or operational needs, in accordance with our Privacy Policy.

12. Disclaimer of Warranties

The Services are provided "as is" and "as available."We do not guarantee:

  • That the Services will be uninterrupted, accurate, or error-free.
  • That data transmission will be secure from all threats.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, GPS Tracking Solutions Ltd. is not liable for:

  • Any indirect, incidental, special, or consequential damages.
  • Loss of data, revenue, or business.
  • Unauthorized access to your data due to your own negligence.

Our total liability shall not exceed the amount you paid us in the past 12 months.

14. Indemnification

You agree to indemnify and hold harmless GPS Tracking Solutions Ltd., its officers, and employees from any claim or demand arising out of your use of the Services, your violation of these Terms, or your violation of applicable law or third-party rights.

15. Changes to Terms

We may update these Terms from time to time. We will notify users via email or in-app message when changes are significant. Continued use after such changes constitutes your agreement to the new Terms.

16. Governing Law

These Terms are governed by the laws of Nepal. Any disputes will be resolved in the courts of Kathmandu, unless otherwise required by local consumer law.
